Certain portions of Test Pro service may include, display, or make available content, data, information, applications or materials from third parties (“Third Party Materials”). You understand that by using the Services, you may encounter Third Party Materials and other content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that may automatically and unintentionally contain links or references to objectionable material. Nevertheless, you agree to use Services at your sole risk and that Test Pro shall not have any liability to you for content that may be found to be offensive, indecent, or objectionable, or that is inaccurate, incomplete, untimely, invalid, illegal, indecent, of poor quality or otherwise.

11. Governing Law

Any claim relating to this web site shall be governed by the laws of the State of California without regard to its conflict of law provisions.

12. Withdrawal and Refund Policy

To comply with California Private Postsecondary Education Act of 2009 (as amended January 1, 2023) §94920 TESTPRO LLC adopts the following policy: (a) A notice of cancellation shall be in writing using a special Refund form that can be requested from Support team (a ticket in Learning management system or by email to info@testpro.io). A withdrawal may be effectuated by the student’s written notice or by the student’s conduct, including, but not necessarily limited to, a student’s lack of attendance. (b) The institution shall refund 100% of the amount paid for institutional charges, less an application fee of $250, if notice of cancellation is made through attendance at the first class session, or the seventh day after enrollment, whichever is later. (d) The refund policy for students who have completed 60% or less of the period of attendance shall be a pro rata refund, less an application fee of $250. (e) The institution shall pay or credit refunds within 45 days of a student’s cancellation or withdrawal. A refund can be considered only for a first-time student. Re-enrolled students cannot apply for a refund.

13. Disputes

If student opens a dispute in a financial institution prior requesting a refund or receiving a resolution about previously submitted refund request from TESTPRO LLC, a civil lawsuit gets initiated automatically against a violation of Private Postsecondary Education Act (mentioned above). In the event of any dispute hereunder, the prevailing party in any arbitration or litigation will be entitled to recover all excessive fees and all costs, as described in the Attorneys’ Fees policy below.
